As the case rumbles through court, a key piece of evidence, meant to support Evolution’s defence was a report carried out by specialist gaming advisors Spectrum Gaming Capital. It analysed Evolution’s operations and was meant to counter the damning Black Cube report.

However, until very recently the report was kept confidential by Evolution, as it contained commercially sensitive material, the supplier said.

But this week the 2022 report was released in full by the court. Playtech, for its part, has celebrated a number of findings in the document, which it says supports and corroborates findings from Black Cube.

When excluding those who only played lottery draws, participation stood at 28%, implying lottery-only players comprised roughly 21% of the adult population. 

Online gambling participation over four weeks reached 39% (16% excluding lottery-only players), while in-person gambling participation was 29% (18% excluding lottery-only players).

Papaya, headquartered in Israel, quickly secured a temporary stay of proceedings from the Tel Aviv District Court and filed a Chapter 15 petition with Delaware’s U.S. Bankruptcy Court. The Chapter 15 petition seeks to prevent Skillz from initiating collection efforts until its appeals play out.

Papaya concedes that it cannot immediately pay the $719 million judgment, arguing that allowing the company to pay the penalty over multiple years would “preserve … the rights of all parties.”

Papaya games consist of Solitaire Cash, Bingo Cash, and Bubble Cash.
